Dear Editor,
I was very happy to read in The Nation of the 17th and 21st February that the Law Commission has recommended the abolishment of the mandatory death penalty in treason and murder cases. I agree with you that only God himself has the "prerogative to terminate what He Himself brought on earth". Another very important step is that the Law Commission wants to raise the age at which a person can be charged for a crime from the prescribed ages from 12 to 14 years.
Malawi has made tremendous steps towards improving its human rights within the last few years. And I want to encourage you to continue your work! As a member of amnesty International, I know from statistics and reports the capital punishment has never been shown to deter crime more effectively than other punishments. The use of capital punishment diverts attention from the need to improve law enforcement systems and to address the underlying causes of crime.
Death penalty violates the right to life and the right not to be subjected to cruel, inhuman or degrading treatment or punishment.
And as judicial systems are fallible, innocent people may be wrongly convicted and executed before errors are discovered. Executions afford no opportunities to remedy errors!
